Upon choosing a site for purchasing and negotiating the basic terms and conditions related to the sale and purchase of the real property in Bulgaria, what follows is signing a preliminary contract for sale and purchase. Very often, especially when purchasing sites that are in the process of construction, the preliminary contract is signed upon paying the booking deposit, which usually amounts to 1000 - 2000 Euros. This deposit becomes the reason to discontinue the sale of the real property and fix the price. In the preliminary contract the main terms and conditions of the transaction are stipulated, the same that will be later determined in the Title Deed, namely: detailed description of the real property in Bulgaria, for the residential premises that are in the process of construction - deadline for the on-site commissioning, price, terms and conditions, and the payment terms. The payment schedule is determined by the builder for each particular case and depends mainly on the state of the completion of the site. It could be something like that: 30% - upon signing the preliminary contract, 40% - upon state of the completion of the site certified by Act 15, 30% - upon signing the Title Deed.
When signing the preliminary contract for the sale and purchase of real estate in Bulgaria, for sites in the process of construction it is necessary to get acquainted with the specific documents, such as construction permit for the respective building tenancy. We recommend that you look at sites that have already been built by the particular construction company. Upon signing the preliminary contract a deposit to the amount of 10% of the selling price is paid, but it can also be 15-20%. In case both parties agree, they may not sign a preliminary contract, but the Title Deed for transferring the ownership, by which you immediately obtain the right to dispose of the real property. This is done in case the purchaser is willing to pay the full price of the property right away.

Notary certification of the transfer of possession and ownership over the real property. The transaction of purchasing real property in Bulgaria is registered before a Notary, in whose region of activity the respective property is located. For transferring the property (performance of the notary formalities related to the sale), the foreign citizen has to present a passport. When the purchaser and vendor sign the Title Deed and the Notary certifies their signatures, the Notary then submits the signed ownership document to the District Court. A Judge incorporates the change in the circumstances for the specific property in the civic real property register. This change is also stated in the Title Deed itself, which is the primary document certifying ownership right in Bulgaria.
Before the transaction the Notary is shown an encumbrances certificate issued by the respective register,; this certificate shows that the respective property is not encumbered and there are no alien rights over it.
The certificate shows the presence or absence of mortgage, right of usage by third persons over the property, sale prohibition, litigation, etc. It also confirms the right of ownership over the site of the specific person - the vendor.
The registration of the acquired property in Bulgaria in the local tax department and the registration in the BULSTAT register - all this is taken care of by our legal office.
